We have wide experience in public procurement consultancy. In the scope of our business activity, we provide services to both the Economic Operators submitting a tender offer in contract award procedures and the Awarding Entities with regard to efficient organisation of tenders.
To the Awarding Entities we provide support within the scope of the choice of appropriate mode of proceedings, preparing internal documents of the Awarding Entity (among others, the regulations on conducting contract award procedures, regulations on appointing and work of the tender committee), drawing up terms of reference form, tender notice and model contract and also assessment of compliance of the documents prepared by the Awarding Entity with the provisions of the Public procurement law, consultations at the specification of the conditions for participation in the proceedings, legal assistance during contract award procedures, substantive consultations in the process of evaluations of tender offers, examining the grounds for protests and appeals lodged by the Economic Operators, preparing projects of protest resolutions and legal representation in the disputes before the National Appeal Chamber and regional courts.
To the Economic Operators we offer substantive consultations in the process of preparing the offer, evaluation of the terms of reference and model contract concerning compliance with the Public procurement law, preparing protests to the Awarding Entity, appeals to the National Appeal Chamber and complaints lodged to the regional court and legal representation before the Awarding Entity, the National Appeal Chamber and regional courts, preparing model letters for the correspondence between the Economic Operator and the Awarding Entity at the stage of examination and evaluation of tender offers (among others, providing explanations to the offer as requested by the Awarding Entity), evaluation of competitive offers and indicating mistakes in them.
Services provided to the Economic Operators:
a. Evaluating the contents of the terms of reference, especially within the scope of the terms of participation in the procedure and the model contract;
b. Substantive consultations during preparation of the offer;
c. Preparing models of inquiries to the Awarding Entity within the scope of providing explanations as to the terms of reference, preparing model legal protection measures pertaining to the contents of the terms of reference;
d. Preparing model letters for the correspondence between the Economic Operator and the Awarding Entity at the stage of examination and evaluation of tender offers (among others, providing explanations to the offer as requested by the Awarding Entity);
e. Evaluation of competitive offers and indicating mistakes in them;
f. Preparing legal protection measures aimed at ensuring the choice of the Economic Operator's offer as the most favourable one (protest, appeal to the National Appeal Chamber, complaint to the regional court);
g. Representation in protest, appeal and complaint proceedings;
h. Drawing up requests to the President of the Public Procurement Office for conducting ad-hoc inspection at the Awarding Entity;
i. Carrying out control of the procedures applicable in the Economic Operator's enterprise within the scope of participation in contract award procedures and proposing and participating in the implementation of essential corrective and remedial actions;
j. Conducting internal trainings for personnel dealing with preparing public procurement offers;
k. Providing ongoing information about the changes in the public procurement law and about current legal reasoning in the decisions of the National Appeal Chamber;
l. In the event of individual request from the Client, the above-mentioned activities can be conducted in English language.
Services provided to the Awarding Entities:
a. Preparing model terms of reference with annexes;
b. Consultancy with regard to the choice of appropriate mode of contract award procedure;
c. Correspondence with the Economic Operators, legal supervision and formulating justifications to the Awarding Entity's decisions;
d. Representing the Awarding Entity before the National Appeal Chamber and regional courts in the cases resulting from appeals and complaints lodged by the Economic Operators;
e. Consultancy with regard to other activities of the Awarding Entity aiming at selecting the most favourable offer.
